Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Section 96 of the Bharatiya Nyaya Sanhita, 2023 and charge has been framed under Sections 96, 65(1) of B.N.S., 2023 and under Section 4(2) of POCSO Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has committed no offence as alleged in the F.I.R. He further submits that the charge has been framed on 30.10.2025 and the victim in her statement under 183 of BNSS, 2023 has stated that she went with the petitioner out of her own free will and she has not stated anything about physical relationship with the petitioner. He further submits that the petitioner is a student and the petitioner for no offence has been languishing in custody since 13.09.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court.

Learned A.P.P. opposes the prayer for bail of the petitioner.

Having regard to the statement of the victim girl coupled with the fact that the petitioner is a student; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO) Godda in connection with Godda (Town) P.S. Case No. 181/2025 corresponding to Special POCSO Case No.103/2025.

It is made clear that the as the petitioner is a student, he shall appear before the learned trial court as and when required by the learned Trial Court and he shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
