CRL.OP.(MD)No.12989 of 2026 ORDER The present criminal original petition has been filed by the sole accused in Crime No.313 of 2023 on the file of the Inspector of Police, Courtallam Police Station seeking to quash the FIR wherein the petitioner is alleged to have committed offenses under Sections 7 and 8 of the Protection of Children from Sexual Offences Act, 2012. Act, 2012. 2.The FIR has been registered on 13.09.2023 initially as a girl missing case and later altered and Sections 7 and 8 of the Protection of Children from Sexual Offences Act, 2012 have been invoked. The victim girl, who was 17 years old at the relevant point of time, has been examined by the learned Judicial Magistrate, Alangulam under Section 164 of the Criminal Procedure Code. 3.A perusal of the 164 statement reveals that the petitioner has not misbehaved with the girl and there is no allegation of sexual harassment. The victim girl was missing and her father, who is the defacto complainant had lodged a complaint and she was located on the next day. 4.The defacto complainant had appeared before this Court and submitted that on attaining majority, the victim girl has got married to another person on

CRL.OP.(MD)No.12989 of 2026 criminal case and therefore, he does not want to prosecute the same. Especially in the light of the fact that no allegation of sexual harassment has been made as against the petitioner herein. 5.After completing investigation, charge sheet is said to have been filed by the first respondent police on 26.07.2025. However, it has not been taken on file so far.
6.The parties have entered into your compromise wherein the defacto complainant had agreed for quashing of the charge sheet as against the petitioner herein. Today ie., 01.07.2026, he is present before this Court and pleaded that the charge sheet may be quashed on the ground that his daughter has already got married to another person two years back. 7.In such view of the matter, Crime No.313 of 2023 registered on the file of the first respondent police stands quashed and the criminal original petition stands allowed.
