CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents.
2. Learned Counsel for the petitioners submits it cannot be disputed by the respondent-authorities that 4.00 Acres of land in Sy.No.18 of Hosahalli village, Sulibele Hobli, Hosakote Taluk was granted at upset price of Rs.400/- per acre in favour of Sri.Munisonnappa D/o Dyavanna, on confirmation under ‘Grow More Food Scheme’. However, it was later found that the petitioners were in occupation of excess of 1 Acre 32 Guntas and in that regard, for grant, the respondent-Tahsildar levied T.T.fine of Rs.453.60/- per acre. Aggrieved of the said imposition of the T.T.fine, the grantee-Sri.Munisonnappa preferred an appeal before the Assistant Commissioner. However, the Assistant Commissioner held that he had no jurisdiction and therefore, the grantee approached the Divisional Commissioner. During the pendency before the

Divisional Commissioner, in view of the amendment brought to the provision of law, the matter was made over to the Karnataka Appellate Tribunal. Therefore, the Tribunal took up the matter and passed an order in Appeal No.1028/1976, dated 31.10.1979, clearly holding that the levy of T.T. fine should be confined only to 1 Acre 32 Guntas and not in respect of 4.00 Acres, which were earlier granted in favour of Sri.Munisonnappa. Learned Counsel submits that despite such directions being given by the Tribunal, no order was passed by the Tahsildar. Ultimately, in terms of the oral directions given by the Tahsildar and the challan issued to the petitioners, the petitioners have paid Rs.20,000/- on 17.06.2023, as found at Annexure-L. In spite of the respondents collecting the kimmath/T.T. fine, the Tahsildar has not entered the name of the petitioners, who are the legal representatives of late Sri.Munisonnappa in the revenue records. The prayer therefore in this writ petition is to direct the Tahsildar, Hosakote Taluk to consider the representation given by

the petitioners at Annexure-M dated 22.08.2025 to enter their names in the revenue records.
3. Having regard to the contentions raised by the
learned Counsel for the petitioners and on perusing the petition papers, this Court is of the considered opinion that the 4th respondent-Tahsildar, Hosakote Taluk is duty bound to proceed to enter the name of the petitioners revenue records pursuant to Kimmath/T.T.fine collected as evidenced at Annexure-L. The entire exercise shall be completed as expeditiously as possible and at any rate within a period of Three (3) months from the date of receipt of a copy of this order. It is made clear that the question of dispossession of the petitioners from the land in question would not arise and no precipitative action shall be taken in that regard by the respondent- authorities.
4. With these observations, the writ petition stands
disposed of.
