Since common questions of facts and law are involved in these petitions, therefore, these are being heard and decided together. However, for the sake of brevity and convenience, facts of Writ Petition (SS) No. 1281 of 2025, alone are being considered and discussed. 2. Petitioner was engaged as Data Entry Operator in Nagar Palika Parishad, Dugadda, Pauri Garhwal on contract w.e.f. 01.03.2011. According to petitioner, she served continuously in that capacity till 20.07.2025 to the satisfaction of all concerned; however, on 21.07.2025, Executive Officer, Nagar Palika Parishad, Duggada, terminated her service. Petitioner has challenged the said termination order. 3. The sole reason assigned for terminating service of the petitioner is the 2026:UHC:3407 directive issued by Urban Development Directorate, Dehradun on 30.11.2024, whereby Nagar Palika Parishad, Duggada was directed to discontinue engagement of casual employees which was made on a post without prior permission of the State Government. 4. Learned counsel for Nagar Palika Parishad submits that revised cadre structure of Nagar Palika Parishad was sanctioned on 12.06.2015 and in the Government Order, it was provided that engagement on contract against sanctioned post shall be made only with the prior permission of State Government. 5. Learned counsel for the petitioner submits that petitioner was engaged as Data Entry Operator in 2011, much before issuance of Government Order dated 12.06.2015, therefore, discontinuance of her engagement for the reason indicated in the impugned order is unsustainable. 6. It is submitted that petitioner’s service could have been terminated only if there was some complaint against her work or performance or if the work and post was not available. 2026:UHC:3407 7. It is contended that none of the aforesaid two contingencies exist inasmuch as there is no complaint against petitioners’ work and performance; it is also not the case of the respondents that requirement of Data Entry Operator is not there in Nagar Palika Parishad. 8. Learned counsel for Nagar Palika Parishad then submits that regular appointment was made on the post of Data Entry Operator in the Nagar Palika Parishad; however, he cannot make any definite statement regarding number of persons who were regularly appointed as Data Entry Operator in 2023. 9. The reason assigned for terminating petitioner’s engagement does not appear to be justified. A person who is serving since 2011 cannot be terminated, merely because in 2015, directive was issued by Urban Development Directorate not to engage any person against a sanctioned post without prior permission of the State Government. 10. As petitioner was engaged much earlier, and had put in more than 04 years of service in 2015 when such directive was issued, therefore engagement of the petitioner cannot 2026:UHC:3407 be disturbed based on the directive. But there is another aspect of the matter, i.e., petitioner was engaged on contract and he does not have lien on the post. 11. Having regard to the facts and circumstances of the case, the writ petitions are disposed of by permitting petitioners to approach competent authority regarding their re-engagement on contract. 12. If petitioners make representation for their re-engagement within two weeks, decision thereupon shall be taken sympathetically by the competent authority within eight weeks thereafter. It shall be open to the petitioners to stake claim for continuity of service for the period they remained out of employment. 13. It goes without saying that competent authority shall consider the representation submitted by petitioner independently untrammelled by this order or observation made by this Court.
