The writ petition has been filed in the nature of Mandamus seeking a direction against the respondents 1 and 2 to take action to remove the encroachments made by the third respondent in the road and also in the road margin in front of commercial shopping complex shops of Singampunari Town Panchayat, near Singampunari Bus Sand, Singampunari Weekly market, consequent to the notice issued dated 08.08.2025 by the 2nd respondent. It is the contention of the petitioner herein that he had been allotted shop No.19 in the commercial shopping complex, which is situated near the Singampunari Bus stand and Singampunari Weekly market. There were totally 22 shops. The petitioner claims that he is doing grocery business. It had been stated that the pathway in front of the shopping complex had been encroached by the third respondent, who had been allotted shop No.18. It is under those circumstances, the writ petition had been filed seeking removal of the encroachments. 3. Mr.M.P.Senthil, learned counsel for the State, however contended that both the petitioner and the third respondent are unauthorized occupiers of the portion of the land beyond their allotment. It had been contented that in order to remove the said encroachments by the petitioner and the 3rd respondent and several others, notices had been issued on 08.06.2026 by the second respondent/Executive Officer, Singampunari Town Panchayat, Sivagangai District. 4. It had been contented that after the receipt of the said notices, the petitioner had filed the writ petition complaining about the alleged https://www.mhc.tn.gov.in/judis WP(MD)No.18865 of 2026 encroachment made by the 3rd respondent, when the petitioner himself is an encroacher. We would only direct the second respondent to proceed in manner known to law against all those, who had been issued with notices, and remove all the encroachers/all encroachments, whether it is of the petitioner or of the 3rd respondent or of anybody else, since the petitioner lacks bona fide.
