ORDER : The Court made the following order :- The petitioner/A4, who was arrested and remanded to judicial custody on 29.04.2026, for the offences punishable under Section 191(2), 191(3) and 103(1) of BNS, 2023, in Crime No.221 of 2026 on the file of the respondent Police, seeks bail. 2. The allegation against the petitioner is that he belongs to a gang operating in a village and that there is enmity between his gang and another gang. Hence, with a view to getting rid of the deceased, namely Maariselvam and after waiting for an opportunity, on the date of occurrence, they waylaid the deceased and attacked him with deadly weapons thereby committing the murder of the deceased. Hence, the case has been registered and the petitioner and other accused person were arrested. 3.The learned counsel for the petitioner submitted that the petitioner herein has been arrayed as A4 in this case. No.11541 of 2026 submitted that though a specific overt act has been attributed to the petitioner based on the confession statement, there is no direct eyewitness to the occurrence. He is ready to cooperate with the investigation. He further submitted that the petitioner is not having any previous cases. Hence, he prayed for grant of bail to the petitioner. 4.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police submitted that totally nine accused in this case. The petitioner herein is ranked as A4. The petitioner has no previous cases. He further submitted that the specific overt act attributed against the petitioner is that he attacked the deceased with knife. Hence, he strongly opposed to grant bail to the petitioner. 5.Heard the learned counsel on either sides and perused the materials available on records including the confession statement of the co-accused. 6. On a perusal of the records, it is revealed that it is not a case of a sudden quarrel, but a pre-planned murder. It is further revealed that the 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.11541 of 2026 accused had conspired together, waited for an opportunity and continuously monitored the movements of the deceased. Subsequently, they committed the murder of the deceased. The specific overt act attributed against the petitioner is that he attacked the deceased with knife. Hence, this Court is not inclined to consider the petition for grant of bail to the petitioner. 7. Accordingly, this Criminal Original Petition stands dismissed.
