In Re : Abhay Kumar Sharma ... Petitioner.
Mr. Prasun Kumar Datta, Mr. Santanu Deb Roy
... For the Petitioner.
Mr. Satadru Lahiri, Mr. Jnip Bose
... For the State.
Learned advocate appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in connection with the instant case. It has been submitted that petitioner is similarly situated as the other accused person who has been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there has been recovery of arms from the present petitioner and petitioner has got criminal antecedents having three other criminal cases under the Arms Act which are registered at Bihar. Having regard to the recovery in the present case as well as the petitioner having criminal antecedents, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.
2 Learned Trial Court would expedite the process of trial by at least completing the vulnerable witnesses within a reasonable period of time. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1699 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
