Senior Civil Judge & CJM, Hassan, whereby the request of the petitioners to receive the written statement was rejected by the Trial Court. 2. Learned counsel for the petitioners submits that defendant No.3, is their relative, who would be filing written statement in the aforesaid suit on 22.01.2026 i.e., when the matter is said to be posted before the Trial Court. It is submitted that the matter may be disposed of reserving liberty in favour of the petitioners to file a memo seeking adoption of the written statement to be filed by defendant No.3 in the said aforesaid suit. 3. The said submission is placed on record. 4. Accordingly, the petition stands disposed of. In the event, defendant No.3 files his written statement in O.S.No.392/2025 on 22.01.2026 or any other date to which the matter is adjourned, the petitioner would be entitled to file a memo - 3 - HC-KAR NC: 2026:KHC:3131 WP No. 1536 of 2026 seeking adoption of the said written statement of defendant No.3.
