D/L.08. October 01, 2026. KAUSHIK RVW 129 of 2026 Prosenjit Mondal Vs. The State of West Bengal & Ors. Mr. Pradip Kumar Kundu … for the petitioner 1. This is an application for review of an order dated 16 April, 2026. 2. Briefly, the petitioner had assailed a sale certificate issued by the respondent bank in conducting a sale under the provision of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI). 3. By the impugned order, in view of the alternative efficacious statutory remedy under the provisions of the SARFAESI Act, this Court had refused to interfere and granted liberty to the petitioner to avail of its statutory remedy in accordance with law. 4. The petitioner seeks review of the order dated 16 May, 2026 on the ground that the remedy under Section 17 is not available to him on the ground that the statutory period of 45 days have expired. It is an admitted position that 2 the sale had been conducted by the respondent bank was under the provisions of the SARFAESI Act. 5. In view of the above, there are no grounds which the petitioner has been able to demonstrate warranting review of the order dated 16 May 2026. 6. RVW 129 of 2026 alongwith any connected application stands dismissed. However, there shall be no order as to costs. (Ravi Krishan Kapur, J.)
