CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER Learned Additional Government Advocate takes notice for both the respondents. 2. It is the contention of the petitioners that it is not disputed at the hands of the respondent authorities that 2 acres and 20 guntas of land in Survey No.53 of Entaganahalli Village, Kasaba Hobli, Nelamangala Taluk, was regularized in favour of petitioners’ father Late Sri Puttamaraiah, in the year 1978. Pursuant to which, Saguvalichit was also issued on 31.03.1979, as could be seen at Annexure- A1.
However, a notice is said to have been issued by the Deputy Commissioner as found in Annexure-A3 dated 07.09.2001 that since the petitioners are not in cultivation of the lands for more than 10 to 12 years, the petitioners were asked to show cause as to why the grant should not be cancelled. However, learned counsel submits that the petitioners have not received such a notice. Nevertheless, it is submitted that from the

information available in the writ petition, it is clear that the grant has not been cancelled. Therefore, the prayer in the writ petition is to issue a writ of mandamus directing the respondents to enter the name of the petitioners in the revenue records. 3. Having regard to the contentions raised by the petitioners, the writ petition stands disposed of with a direction to the respondents to verify from the records as to whether there is any order passed canceling the grant. If any such order of cancellation of grant is passed, certified copy of the same shall be given to the petitioner. The petitioners are at liberty to question the same. However if the grant is not cancelled, then the respondent No.2 – Tahsildar, Nelamangala Taluk is directed to proceed to find out as to who are the legal heirs of lat Sri Puttamaraiah, the original grantee and enter their names in the revenue records. The entire exercise shall be completed as expeditiously as possible and at any rate
