THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard learned counsel appearing for the parties. 2. The petitioner herein has sought for appointment of the Arbitrator based on the Development Agreement dated 21.12.2017(Annexure-A), wherein Clause-11 provides for resolution of the dispute between the parties, by an Arbitrator, under the Provisions of the Arbitration and Conciliation Act, 1996. 3. Sri. Badri Vishal, learned counsel appearing for the respondent No.1(a) placed on record the Order dated 22.08.2022 in Commercial A.A. No.17/2021 on the file of the X Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru, wherein, the parties have settled the - 4 - HC-KAR NC: 2026:KHC:18046 CMP No. 212 of 2022 dispute, which is forthcoming from paragraph 40 of the Order, and accordingly sought for dismissal of this Petition. 4. In the light of the submission made by the learned counsel appearing for the parties, the petitioner is placing reliance on Clause 11 of the Development Agreement dated 21.12.2017 (Annexure-A), which is also forthcoming from the settlement between the parties as stated in paragraph 40 of the Order dated 22.08.2022 in Commercial A.A.No.17/2021, referred to above. In that view of the matter, I am of the view that, no interference is called for in the matter as the parties have settled the dispute. 5. Accordingly, the Civil Miscellaneous Petition is dismissed.
