And In Re : Firoj Hasan alias Md. Firoj and another ... Petitioners. Mr. Sekhar Kumar Basu, Sr. Adv., Mr. Kusal Kumar Mukherjee, Mr. Arijit Bose ... For the Petitioners. Mr. Gouranga Kumar Das, APP, Mr. Sajal Kumar Pandit ... For the State. Learned senior advocate appearing for the petitioners submits that petitioners were arrested on 20.05.2026 and since then they are in custody; charge-sheet has already been submitted and so far as the petitioner no.2 is concerned, there are no criminal antecedents. However, there are three criminal cases against the petitioner no.1. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the seizure list in respect of the recoveries which were made from both the petitioners. It is seen that so far as the petitioners are concerned, the following seizures were effected : “The petitioner accused persons namely Firoj Hasan @ Md. Firoj Govind and Md Sanu have been recovered 2 (two) Pcs of Country made one shutter pipe gun, 2 (two) pcs of improvised 2 fire arms seems to be 7 mm pistol from the possession of Firoj Hassan and 4 (Four) magazine, 20 (Twenty) pcs of 7.65 KF live Ammunition, 10 (Ten) pcs 8 mm KF live ammunitions from the exclusive possession of Md Sanu.” Having considered the nature of the seizure which has been made, at this stage, I am not inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1960 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
