Heard Learned Counsel Mr. K D Singha, appearing for the petitioner and also heard Learned PP Mr. R Datta, appearing for the State respondent. This petition under Section 528 of BNSS, 2023 is filed for directing the State-respondent to take necessary action against the accused in connection with West Agartala P.S. case No.2025 WAG 034 dated 09.04.2025 under Sections 420/407/423/120(B) of IPC.
Taking part in the hearing, Learned Counsel for the petitioner submitted that the aforesaid case is pending before the Court of Ld. CJM, West Tripura, Agartala and in that case the accused sought for pre-arrest bail which was allowed by Learned Addl. Sessions Judge, West Tripura, Agartala, Court No.4 by order

dated 17.04.2025 in BA 62/2025 and thereafter, a petition was moved on behalf of the petitioner before this High Court for cancellation of the bail granted to the respondent accused and this Court by order dated 02.08.2025 passed in BA No. 43/2025 was pleased to set aside and cancel the order passed by Ld. Addl. Sessions Judge, West Tripura, Agartala. After that the respondent accused approached the Hon’ble Supreme Court and by order dated 15.01.2026 in SLP Crl. No. 16543/2025 the petition filed was dismissed and the interim protection granted was withdrawn. According to the Learned Counsel, till today no chargesheet has been submitted in this case and no step has been taken from the side of the prosecuting agency to arrest the accused in this case.
Learned PP Mr. Datta, submitted that until and unless the petitioner approaches the Court of Ld. CJM, there is no scope to grant any relief.
I also concede with the submission of Learned PP.
Accordingly, I find no merit in this petition. Hence the same is thus dismissed.
However, liberty is given to the petitioner to approach the concerned Jurisdictional Magistrate for passing appropriate
order. With this observation, this petition stands disposed of.
