The petitioner is not pressing first prayer. In the first prayer the petitioner prayed for a direction upon the respondents to produce the marks of the petitioner. 3. The petitioner is pressing the second prayer. The second prayer is that she should be appointed against the vacant post. Appointment to a particular post is neither a fundamental right nor a vested right. The petitioner has to show that she has come within the zone of consideration and the person who has been appointed has obtained lesser marks than the petitioner in her subject and category. In the entire petition there is nothing to suggest that what 2026:JHHC:5453 2 is the marks the petitioner has obtained nor it has been submitted that any person having lesser marks than the petitioner has been appointed in the subject and category of the petitioner. 4. Thus, the petitioner in this writ petition has not made out any grounds for entertaining the same. 5. Inspite of the fact that there are vacancies, the petitioner cannot claim by right to be appointed against the said vacant post. 6. Thus, I find no merit in this writ petition, the same is dismissed in the absence of vital information. 7. If in future it is discovered that any person in the category and subject of the petitioner obtaining lesser marks than the petitioner has been appointed, it will be open to the petitioner to approach the Jharkhand Staff Selection Commission (JSSC) claiming for her recommendation.
