HC-KAR NC: 2026:KHC:3888 WP No. 1766 of 2026
CORAM: HON'BLE MR. JUSTICE B M SHYAM PRASAD
ORAL ORDER The petitioner's son [Mr. Aditya @ Mani] is convicted for the offences punishable under Sections 302, 201 r/w 34 of IPC in S.C. No.89/2012 on the file of the Principal District and Sessions Judge, Mandya. The petitioner's son has been in prison for over 14 years and is entitled for remission of 2 years and he has not sought for parole during this time. The petitioner's present request for her son's parole is the first, and it is to attend to her daughter's wedding [sister of the convict] scheduled to be held on
25.01.2026.
On the previous occasion, when the learned counsel for the petitioner proposed to rely upon a wedding certificate, this Court has permitted the petitioner to file an affidavit in support of her case that her son must be admitted to parole. In terms of the liberty reserved by this Court, the petitioner has

filed an affidavit furnishing the details of some of the purchases made and the arrangements put in place. Ms. Saritha Kulkarni, the learned Additional Government Advocate, places on record the details of the conviction of the petitioner's son and the Communication by the Office of the Chief Superintendent, Kalaburagi. The petitioner has not sought for bail so far and that no application is even filed for the present occasion.
The petitioner's justification to approach this Court even without filing an application under the Karnataka Prisons and Correctional Services Manual 2021 [the Manual] is the fact that she is a resident of Mysuru District and her son is lodged in Kalaburagi. In the circumstances of the case, and keeping in mind the objectives under the Manual in admitting a convict on parole, this Court is of the view that the petition must be allowed but on just conditions. Hence, the following:
