By way of this bail application, the petitioner prays for grant of regular bail in connection with M.G.M. (Mango Muffasil) Police Station Case No.161 of 2025 corresponding to Cyber Crime Case No.41 of 2025, registered for offences alleged under Sections 308(2)/ 308(5)/ 351(3)/ 77/ 75(2)/ 75(3)/ 78(2)/ 79/ 3(5) of the Bharatiya Nyaya Sanhita, 2023, and under Sections 66(E)/ 67/ 67(A) of the Information Technology Act, pending in the Court of the Special Judge, Cyber Crimes at Jamshedpur. 3. The present case relates to cyber crime. The informant in the First Information Report has alleged that the petitioner met with his sister (victim) in the year 2022, he took her personal mobile number and slowly taking her into confidence, he used to contact her by his mobile number 8797682685. It is alleged that petitioner had stored obscene photographs, video and call recordings of the victim in his laptop and mobile phone without her consent. It is alleged that the petitioner started blackmailing the victim and asked her to establish relationship and later also started demanding huge amount. The victim had transferred an amount of Rs.30,000/- approximately to the petitioner through UPI and also paid Rs.70,000/- in cash. It is alleged that when the victim blocked the mobile number of the petitioner, the petitioner along with his brother Nafish Ansari, through mobile numbers 9334780275, 9296497779, 9771685022 used to threaten the victim as also shared the obscene videos to the whatsapp of informant’s mother and threatened that they would see that marriage is not solemnized. It is alleged that the petitioner threatened that if marriage is solemnized, he would share the obscene videos to her fiancé and will also kill him. Petitioner several times attempted to meet with victim’s fiancé. 4. Learned counsel for the petitioner submits that the petitioner is 2026:JHHC:8181 -: 2 :- innocent and has falsely been implicated in this case. He submits that there was love affair between the petitioner and the victim. He submits that the petitioner and the victim were working in Sunrise Tiles since 2022 and were in cordial relation, which was consensual in nature. The victim used to take loan from the petitioner through online mode and she has returned the loan amount to the petitioner. The victim had asked for further loan amount from the petitioner and on being declined, she became violent and aggressive and threatened the petitioner with dire consequence and that she will file false cases against the petitioner. He submits that charge under Sections 308(2)/ 308(5)/ 351(3)/ 77/ 75(2)/ 78(2)/ 79 of the Bharatiya Nyay Sanhita, 2023 and Section 66(E)/ 67/ 67(A) of the Information Technology Act has already been framed in this case. 5. Learned A.P.P. appearing for the State vehemently oppose the prayer for bail of the petitioner. 6. From the records including the order passed by the Court below and from the arguments of the parties, I find that the informant in his re- statement, victim in her statement and other witnesses in their statements have supported the allegations. The printout of mobile screen shots and other documents have been produced by the victim to the police, which were seized under a production-cum-seizure list. The electronic devices have also been seized on disclosure made in confessional statement. The bank statements and CDR have also been collected in course of investigation, which support the allegations in the First Information Report. The victim has been blackmailed and exploited. 7. Considering the nature of allegation and the aforesaid materials, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner in connection with M.G.M. (Mango Muffasil) Police Station Case No.161 of 2025, corresponding to Cyber Crime Case No.41 of 2025, pending in the Court of the Special Judge, Cyber Crime at Jamshedpur, is hereby rejected. However, petitioner may renew his prayer for bail after examination of the victim. 8. This bail application is, accordingly, dismissed. (Ananda Sen, J.)
