M/L.297 Rakib (Rejected) CRM (M) 2704 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baruipur (Women) Police Station case no. 136 of 2022 dated 02.11.2022 under Sections 376(2)(f)/376(2)(n)/354C/506 of the Indian Penal Code and Section 6/15(3) of the POCSO Act, 2012. And In the matter of : Tariful Purkait @ Tarikul ……Petitioner. Mr. Deepak Kumar Prahladka .....for the Petitioner Ms. Manisha Sharma Mr. Subhajit Cholwdhury ……for the State. Learned advocate for the petitioner submits that petitioner is in custody for three years three months and till date no witness has been examined. State has failed to execute its duties. The Superintendent of Police, Baruipur Police District is directed to engage a Nodal Officer who will monitor the day to day progress of the trial. Learned Special Court is directed to fix a schedule consisting of three dates and in a month at least one schedule be fixed. At least 10 witnesses be examined within the next five months. So far as the merits of the case are concerned, I have assessed the same and I am of the view that this is not a fit case for granting bail. As such, the prayer for bail of the petitioner in CRM (M) 2704 of 2025 is rejected. 2 Petitioner will renew his prayer for bail after the aforesaid period is over. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
