Order On Board 13-2-2026 1 The petitioners have preferred this writ petition under Article 226 of the Constitution of India seeking following reliefs :
“10.1 That this Hon'ble Court may kindly be pleased to call for the explanation from the respondents No. 3 & 4 as to how they have seized the paddy of petitioner No.2 & 3 by which act the paddy was not procured before last date i.e. 31/01/2026. 10.2 That, this Hon'ble Court may kindly be pleased to give suitable direction to the respondent No.2 to release the seized paddy and made arrangement of procurement of the paddy of petitioner No.2 & 3 which was not procured on time i.e. before 31/01/2026 due to the improper act of respondent No.3 & 4 and also due to the respondent No.2 has not decided the representation of the petitioners within time i.e. before 31/01/2026 which will cause irreparable loss to the petitioner No.2 & 3 from getting benefits of the procurement scheme. 10.3 Any other relief, which may be deemed, fit by this Hon'ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner No.2 & 3." 2
Learned counsel for the petitioners would submit that, petitioners No. 2 and 3 are land owner. They have cultivated paddy. Petitioner No. 1 was caretaker of the agricultural field of petitioners No. 2 and 3. Three tokens were also issued in the name of petitioners No. 2 and 3 for sell
3 of 380 quintals of paddy. Aforesaid paddy was to be purchased in Paddy Procurement Centre, Korbi, Distt. Janjgir-Champa, but one day, said 380 quintal paddy kept in courtyard of petitioner No. 1 was seized by the respondents No. 3 and 4, therefore, the petitioners could not sell their paddy. He would further submit that, various applications (Annexure P-3) dated 8-1-2026 15-1-2026 and 19-1-2026 were filed before the Collector, Janjgir-Champa in this regard, but the same have not been decided. Therefore, at this stage, he would submit that, this petition may be disposed off directing respondent No. 2/Collector, Janjgir-Champa to decide their representation within a stipulated period. 3
Learned counsel appearing for the State would submit that, the representations filed by the petitioners shall be decided expeditiously. 4 Having considered the limited prayer of the petitioners, this writ petition is disposed off with a direction to the respondent No. 2/ Collector, Janjgir-Champa to decide the representations (annexure P- 3) filed by the petitioners expeditiously preferably within a period of 15 days from the date of receipt / submission of this order and if no fault of petitioner is found, then said paddy be purchased as per policy/scheme. 5 With aforesaid directions, this writ petition is disposed off. 6 Pending interlocutory application(s), if any, stands disposed off.
