In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection Kaliachak Police Station case no. 206 of 2025 dated 12.02.2025 under Sections 21(c)/25/27A/29/30 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that from the joint possession of the present petitioner and five others 2.9 kg of brown sugar were recovered and the petitioner is in custody for about a year but there has been no progress in the case because of some of the accused persons are absconding. Learned advocate for the State opposes the prayer for bail. Having regard to the quantity of contraband seized, I am of the view that the trial must progress in the instant case. Accordingly, learned Special Court would split up the trial of case by exhausting the process of law and take steps for progressing with the trial of the case. The process of split up be completed within a period of two months from the date of communication of this order.
2 With the aforesaid observation CRM (NDPS) 167 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
