Respondents 1/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.3655 of 2026 Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus (i) directing the 2nd respondent to conduct a comprehensive, independent, and time bound enquiry into the petitioner's complaint dated 18.03.2026 to verify the recruitment records, reservation records, Community Certificate records, verification records, service records, promotion records and all connected files of the fourth respondent and register criminal action based on the findings of the enquiry and (ii) directing the first respondent to examine the findings of the enquiry and if the allegations against the fourth respondent are substantiated, to take all consequential action in accordance with law, including initiation of disciplinary proceedings, recovery of financial loss, review of pensionary and retirement benefits, cancellation of benefits obtained on the basis of any invalid claim. He has filed this Writ Petition seeking a direction to the second respondent to conduct an enquiry with regard to the Community Certificate of the fourth respondent. 2/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.3655 of 2026 2. It appears that the petitioner attempted to obtain information regarding the community status of the fourth respondent by filing an application under the Right to Information Act, which came to be rejected. Aggrieved by the said order, the petitioner appears to have preferred a First Appeal under Section 19(1) of the Right to Information Act, 2005 before the third respondent. The First Appeal was also rejected on 14.03.2026. Thereafter, the petitioner appears to have preferred a Second Appeal under Section 19(3) of the Right to Information Act before the Tamil Nadu State Information Commission on 18.03.2026. It also appears that the petitioner has filed W.P.(MD)No.12735 of 2026 seeking a direction to the Tamil Nadu State Information Commission to dispose of the said Second Appeal within a stipulated time. He also obtained an order from this Court on 28.04.2026 directing the Tamil Nadu State Information Commission to dispose of the Second Appeal within a period of four months. 3. While so, without even waiting for the outcome of the proceedings before the Tamil Nadu State Information Commission or 3/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.3655 of 2026 obtaining the information sought for by him, the petitioner appears to have simultaneously lodged a complaint before the Vigilance Department and filed the present Writ Petition seeking a direction to the Vigilance Department to conduct a comprehensive and time-bound enquiry on his complaint. 4. The Paragraph (ii) of the prayer itself discloses that the petitioner is not in possession of any material as on date. However, he seeks an enquiry by the Vigilance Department. This Court is not inclined to entertain the Writ Petition. The Vigilance Department is not expected to look into such matters. In the event the petitioner obtains the information sought for, his remedy lies before the competent authority concerned and not before the Vigilance Department. Though this Court is inclined to dismiss this vexatious Writ Petition with costs, considering the earlier Writ Petitions filed by the petitioner in public interest, this Court is inclined to dismiss this Writ Petition without costs. 4/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.3655 of 2026 5.
