The petitioner seeks a direction upon the Enforcement Directorate to conduct an enquiry with regard to the jewellery business run by the private respondent. Learned counsel for the Enforcement Directorate submits that unless a scheduled offence is made out against the private respondent, the Enforcement Directorate is not in a position to initiate enquiry. At this stage learned counsel for the petitioner submits that the petitioner does not intend to proceed in the matter any further. In view of the above, this writ petition is dismissed for non-prosecution. There shall, however, be no order as to costs.
