No.11696 of 2026 PETITION FOR BAIL Under Sec.483 of BNSS PRAYER :- C-6B. For Bail in Crime No. 221 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/A9, who was arrested and remanded to judicial custody on 28.04.2026, for the offences punishable under Section 191(2), 191(3) and 103(1) of BNS, 2023, in Crime No.221 of 2026 on the file of the respondent Police, seeks bail. 2. The allegation against the petitioner is that he belongs to a gang operating in a village and that there is enmity between his gang and another gang. Hence, with a view to getting rid of the deceased, namely Maariselvam and after waiting for an opportunity, on the date of occurrence, they waylaid the deceased and attacked him with deadly weapons thereby committing the murder of the deceased. Hence, the case has been registered and the petitioner and other accused were arrested. 3.The learned counsel for the petitioner submitted that the petitioner herein has been arrayed as A9 in this case. He further submitted that the petitioner has been falsely implicated based on the 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.11696 of 2026 confession statement. Even according to the said confession, it has only been stated that the conspiracy to murder the deceased was intimated to the petitioner herein and that he advised the parties to proceed and assured them that he would take care of the future consequences. Accordingly, the occurrence is alleged to have taken place. The learned counsel further submitted that a false case has been foisted against the petitioner, since the petitioner is having some previous cases. Hence, he prayed for grant of bail to the petitioner. 4.The learned Counsel for the State of TN (Crl. Side) appearing for the respondent Police submitted that totally nine accused in this case. The petitioner herein is ranked as A9. The petitioner is having nine previous cases. Hence, he opposed to grant bail to the petitioner. 5.Heard the learned counsel on either sides and perused the materials available on records including the confession statement of the co-accused. 6. On a perusal of the records, it is revealed that it is not a case of a 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No.11696 of 2026 sudden quarrel, but a pre-planned murder. It is further revealed that the accused had conspired together, waited for an opportunity and continuously monitored the movements of the deceased. Subsequently, they committed the murder of the deceased. The petitioner is involved in nine previous cases. Though it is stated that the conspiracy to murder the deceased was merely intimated to the petitioner herein, he was the main accused who instigated the other accused to commit the murder of the deceased. Hence, this Court is not inclined to consider the petition for grant of bail to the petitioner. 5. Accordingly, this Criminal Original Petition stands dismissed.
