01.10.2026 17 Court No. 05 (DL) (Suvendu Mukherjee)
IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction (APPELLATE SIDE)
WPA 25694 of 2026
Ananga Udaya Panigrahi @ Ananga Panigrahi –Versus – Union of India & Ors.
Mr. Arkaprabha Ray
Mr. Arunava Ganguly
….for the petitioner
Mr. Anirban Mitra
Mr. Tapodip Gupta
…..for the Union of India
1) Affidavit of service filed on behalf of petitioner is taken on record. 2) Petitioner prays for protection by not arresting him by concerned respondent authorities while taking steps in connection with impugned notice dated 24th August, 2026 issued by Sub-Inspector, Narcotics Control Bureau, Kolkata Zonal Unit (for short, “NCB”). 3) On hearing petitioner and NCB authorities, it appears that notice dated 24th August, 2026 was issued to petitioner in connection with NCB Crime No. 15/2026. It is disclosed in notice dated 24th August, 2026 that 77 Kgs of contraband which was believed to be Ganja and a vehicle were seized. 4) It transpires attempt has been made by petitioner by presenting this writ petition to obtain an order
2 thereby directing police authorities not to take coercive steps against him which taking note of contents of said notice dated 24th August, 2026 appears to be impermissible. 5) If petitioner apprehends that steps may be taken against him, in that event petitioner needs to approach appropriate forum under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023. High Court while exercising writ jurisdiction under Article 226 appraising writ petition seeking quashment of criminal proceeding or where prayer is made not to take coercive steps against petitioner, needs to tread warily. Since it is not a routine procedure, therefore discretion is to be exercised sparingly with circumspection. 6) Hence, writ petition stands dismissed. 7) However, this order shall not preclude petitioner to take steps in accordance with law. 8) All parties shall act on server copy of this order duly downloaded from official website of this Court.
