CMP(M) No.496 of 2026 Keeping in view the averments made in the application, duly supported by the affidavit of the official, delay of 116 days in filing the appeal is condoned.
2. The application stands disposed off accordingly. LPA No. 245 of 2026 & CMP No. of 2026
3. Inter alia contends that the learned Single Judge had directed to sanction Grant-in-Aid in favour of the writ petitioner from the date of the appointment on 11.05.2018 by the School Management Committee despite the fact that the employee-petitioner had worked earlier from 15th October, 2008 to 3rd July, 2014 which was on the basis of an appointment by the PTA and thereafter from 11.05.2018. It is thus submitted that there was a break of service of almost four years and the appointment as such was not under the PTA and therefore, the benefit which has been granted to the petitioner as per the policy dated 10.10.2022 (Annexure P- 11) was not sustainable.
3A. Issue notice to the respondent, returnable within four weeks, on taking steps within one week.
4. Till further orders, the operation of the impugned judgment shall remain stayed.
5. Accordingly, the proceedings are deferred for
