According to petitioner, her son was employed in G.B. Pant University of Agriculture and Technology, who died while in service on 10.06.2022. By means of this writ petition, petitioner has staked claim for benefit under New Pension Scheme (NPS). 3. Perusal of the record, however, reveals that petitioner’s son was married to one Ms. Nidhi Singh on 06.12.2019, and marriage between petitioner’s son and Nidhi Singh was never dissolved. 4. Learned counsel for the petitioner submits that petitioner has been made nominee by her son to receive benefit of NPS, while Nidhi Singh was made nominee for getting compassionate appointment. 5. Learned counsel for the University submits that if petitioner makes representation to the competent authority seeking benefit of New Pension Scheme, the same shall be 2026:UHC:3403 considered, as per law. 6. The writ petition is, accordingly, disposed of by permitting petitioner to make representation regarding New Pension Scheme to the competent authority. If petitioner makes representation within two weeks from today, decision thereupon shall be taken by competent authority, as per law, within four months thereafter. 7. It goes without saying that all the stakeholders, including Nidhi Singh shall also be heard while passing any order on the representation submitted by petitioner.
