Learned advocate appearing for the petitioner submits that the petitioner has been detained for alleged recovery of 23.55 kgs. of ganja along with another accused person. Petitioner is in custody for more than 11 months and not only charge-sheet has been submitted but after framing of charge, witness action has commenced. Learned advocate for the State opposes the prayer for bail that the witness action has commenced. Having considered that more than 11 months petitioner is in custody, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sk Ajijul Ali shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty 2 Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District Judge, 3rd Court, Howrah. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Howrah without the prior permission of the learned special court. Accordingly, CRM (NDPS) 81 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
