Srinivasa Rao, learned counsel for the petitioner and Sri Vineeeth Appasani, learned Assistant Government Pleader for Civil Supplies, appeared for the respondents. 2. The petitioner was appointed as a permanent dealer for Fair Price Shop bearing No.0846012 of Kothapalem Village, Chinaganjam Mandal, Bapatla District. The authorisation in respect of the above shop is valid up to 31.07.2027. The Civil Supply Revenue Inspector, Chinaganjam, along with staff, inspected the shop on 07.05.2026 at about 10.30 am and found certain variations. The authority conducted a panchanama vide Ex.P1 and furnished a copy of the same to respondent No.3 to initiate necessary action as per the Andhra Pradesh Targeted Public Distribution System (Control) Order, 2018 (hereinafter referred to as ‘the Order, 2018’). Thereafter, respondent No.3 issued a show-cause notice vide Rc.H/1535/2025, dated 16.05.2026 (Ex.P2). The petitioner submitted an explanation dated 30.05.2026 (Ex.P2). It seems some of the cardholders made a representation to Respondent No.3. 3. Learned counsel for the petitioner would submit that the authorisation of the petitioner was not suspended by respondent No.3; however, neither respondent No.3 nor respondent No.4 released commodities to the petitioner and allowed him to distribute the same to the cardholders. 4. Sri Vineeeth Appasani, learned Assistant Government Pleader for Civil Supplies, appearing for the respondents, on instructions of respondent No.3 would submit that the authorisation of the petitioner has not been suspended so far. The Village Revenue Officer, Kothapalem (I/c) has been appointed as a Fair Price Shop dealer for the distribution of essential commodities to the cardholders. Since there was a transfer in the cadre of Deputy Collector, the proceedings initiated against the petitioner are pending. 5. Thus, as seen from the material available on record, no disciplinary action has been initiated against the petitioner so far in terms of the Order, 2018. In the absence of any order from the competent authority, the petitioner, being the authorised dealer, shall be allowed to continue to supply the commodities to the cardholders. 6. Given the facts and circumstances of the case, keeping the writ petition pending and inviting a counter-affidavit will not serve any purpose. Hence, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel appearing on either side, directing the respondents 3 & 4 to release the commodities to the petitioner and allow him to supply the same to the card holders in respect of Fair Price Shop bearing No.0846012 of Kothapalem Village, Chinaganjam Mandal, Bapatla District immediately. No order as to costs.
