... For the Petitioners.
Mr. Anamitra Banerjee, Ms. Madhumita Sadhukhan
... For the State.
Learned advocate appearing for the petitioners submits that there was a dispute in respect of the village committee and the subsequent committee has foisted a criminal case against the present petitioners. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and submits that the main accusation against the petitioners is misappropriation to the tune of Rs.71,00,000/-. Petitioners were in helm of affairs since 2015/2016. Petitioners have attended the police station on 17.09.2026 pursuant to the notice for appearance under Section 35(3) of the BNSS. Having regard to the same, I am inclined to grant the privilege of anticipatory bail to the present petitioners. As such, the prayer for anticipatory bail of the petitioners is allowed.
2 Accordingly, in the event of arrest, the petitioners viz.,
1. Ramkrishna Ghosh and 2. Kajal Ghosh shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita,
2023.
The petitioners shall make themselves available as and when called for by the Investigating Officer of the case for the sake of investigation. Memo of Evidence and notice for appearance under Section 35(3) of the BNSS submitted by the learned advocate appearing for the State be kept with the record. The application for anticipatory bail, being CRM (A) 2584 of 2026, is, thus, disposed of.
