Heard the learned counsel on either side. 3. The respondent has not filed any counter till date and the learned counsel for the respondent has no serious objection for the transfer application being ordered. However, he would only request for dispensing with the presence of the respondent before the Family Court at Tiruppur on all hearing dates, as otherwise being a Family Court, both the parties will have to appear in all hearing dates. 4. Considering the above concession shown by the respondent, expressing no objection, I am inclined to allow the transfer application. Accordingly, the Transfer Civil Miscellaneous Petition is allowed and the proceedings in HMOP.No.286 of 2024 is hereby withdrawn from the file of the Sub Court, Pollachi and transferred to the file of the Family Court, Tiruppur, where the MC proceedings are pending, to be tried along with M.C.No.152 of 2025. It is made clear that the Family Court, Tiruppur, shall not ordinarily insist on the presence of the respondent-husband and the respondent is entitled to be represented by a counsel of his choice. Considering that the HMOP is pending from 2024 and pleadings are also complete, HMOP.No.286 of 2024 and M.C.No.152 of 2025 shall be disposed of on or before 31.03.2027.
