Guruprasad Government Counsel ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 2 and 3 to consider the petitioner’s applications dated 27.05.2026. 2. The case of the petitioner is that she submitted online applications dated 27.05.2026 to the respondents 2 and 3, requesting them to conduct a survey, fix boundaries for sub-division, and issue a separate Patta for her lands comprised in S.Nos. 293/1B1, 293/1B2, and 293/2I, situated at Paandur Village, Ulundurpet Taluk, Kallakurichi District, in terms of her title deeds—namely, the registered Partition Deed bearing Document No. 923 of 1969 dated 17.06.1969 and the registered Sale Deed bearing Document No. 1282 of 1994 dated 24.08.1994, both on the file of the Sub-Registrar, Ulundurpet. However, the said applications have not been considered till date. Heard the learned counsel for the petitioner and Mr. M. Guruprasad, learned Government Advocate for the respondents. 4. Considering the facts and circumstances of the case and the submissions made by both sides, this Court directs respondents 2 and 3 to consider the petitioner's online applications dated 27.05.2026, conduct a survey of the subject property comprised in S.Nos. 293/1B1, 293/1B2, and 293/2I, situated at Paandur Village, Ulundurpet Taluk, Kallakurichi District, fix boundary stones, and pass appropriate orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after __________ Page3 of 5 https://www.mhc.tn.gov.in/judis WP No. 25253 of 2026 completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 5. With the above directions, this Writ Petition stands disposed of.
