Guruprasad Government Counsel for R1 to R4 Mr.Durai Gunasekaran Government Advocate (Crl.Side) for R5 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 1 to 4 to consider the petitioner’s application dated 18.05.2026. 2. The case of the petitioner is that he submitted an online application dated 18.05.2026 to the respondents, seeking to survey and fix the boundaries of his land comprised in S.F. No. 85/1A, measuring an extent of 0.82.50 Hectares __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 25060 of 2026 situated at Thammapatti Village, Gengavalli Taluk, Salem District, by availing the assistance of the 5th respondent. However, the said application has not been considered till date. Aggrieved by the inaction on the part of respondents 1 to 4, the petitioner is constrained to file the present Writ Petition 3. Heard the learned counsel appearing for the petitioner and learned Government Counsel appearing for the respondents. 4. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the respondents 2 to 4 to consider the petitioner's application dated 18.05.2026, conduct a survey of the subject property in S.F.No. 85/1A to an extent of 0-82.50 Hectors at Thammapatti Village, Gengavalli Taluk, Salem District and fix boundary stones. The respondents 2 to 4 shall afford a fair hearing, after issuing due notice to the petitioner and any other interested parties, and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the 5th respondent / jurisdictional Police, and the 5th respondent / jurisdictional Police are mandated to provide necessary police protection. In the __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 25060 of 2026 event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 5. With the above directions, this Writ Petition stands disposed of.
