For Petitioner(s): Ms.P.J.Anitha For Respondent(s): Mr.A.Vinothraja, Standing Counsel https://www.mhc.tn.gov.in/judis WP No. 23920 of 2026 __________ Page2 of 5 ORDER This Writ Petition has been filed for the following reliefs:- “directing the 1st Respondent consider the representation of the petitioners dated 9.03.2026 to reinstate the petitioner as conductor or any suitable alternative employment with pay protection and to disburse the petitioners arrears amount of salary from the period of 1.02.2022 to 6.08.2025 , 7.10.2025 to till the date within a time limit to be fixed by this Court.” Brief Facts:- 2. The petitioner was appointed in the respondent Corporation in the year 2000 as a temporary Driver and was regularised as a permanent Driver in the year 2006. During the course of his service, he had suffered a heart attack and underwent bypass surgery and angioplasty, for which he was granted four months’ medical leave. 3. After recovery, the petitioner had rejoined duty in December 2021 and was assigned light duty as a Security Guard at Kallakurichi for two months. Thereafter, despite medical advice restricting him to light work, no regular work was assigned and he was referred to the Medical Board. https://www.mhc.tn.gov.in/judis WP No. 23920 of 2026 __________ Page3 of 5 4. The Medical Board, by report dated 09.07.2025, certified that the petitioner was unfit for heavy work (Driver duty) and recommended consideration for light-duty work. Pursuant thereto, he was again engaged as Security Guard from 07.08.2025 to 06.10.2025. During the said period, the petitioner had submitted a representation dated 23.09.2025 seeking appointment as Conductor, as he holds a valid licence. However, the same was not considered. He had thereafter submitted further representations dated 14.10.2025, 05.02.2026 and 09.03.2026 seeking either Conductor post or any suitable light duty. 5. The petitioner was once again referred to the Medical Board, and the Medical Board by its report dated 27.11.2025, opined that he is fit to join duty with restriction that he be assigned work not endangering public safety. Despite the said medical opinion and representations, no suitable alternative employment has been provided to the petitioner to date. Hence, this Writ Petition. 6. Heard the learned counsel on either side and perused the records. 7. Considering the limited sought for by the petitioner and in the absence of any serious objection on the side of the learned counsel appearing for the https://www.mhc.tn.gov.in/judis WP No. 23920 of 2026 __________ Page4 of 5 respondents, this Court without going into the merits of the case, directs the 1st respondent to consider and pass appropriate orders on the petitioner’s representation dated 09.03.2026, on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order. 8.
