Mr. Rohit Kumar, learned counsel holding brief of Mr. I.D. Paliwal, learned counsel for the petitioner and Mr. Ghanshyam Joshi, learned Additional CSC for the State.
2. By the instant petition, the petitioner is praying for the following reliefs:-
“(i) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 1 to decide the Election Petition No.6/2025 "Mohd. Sarfraj Vs Election Officer Vikas Khand Kashipur and others" pending before the court of Prescribed Office/Sub Divisional Magistrate, Kashipur District Udham Singh Nagar plaintiff "Mohd. Sarfraj Vs Election Officer Vikas Khand Kashipur and others within three months or as early as possible which this Hon'ble Court may deem fit and proper in the circumstances of the case. ii) Issue any other or further writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. iii) To award the cost of the petition in favour of the petitioner.”
3. The relief as sought appears to be innocuous.
4. Learned counsel for the State has not objected the said request.
5. In such view of the matter, this writ petition is disposed of finally with the direction to the Prescribed Authority to expedite the Election Petition No.06 of 2025, “Mohd. Sarfaraj vs.
Election Officer, Vikas Khand, Kashipur, District Udham Singh Nagar and Others”, as expeditiously as possible, preferably within a period of six months from the date of presentation of the certified copy of this order.
