Learned advocate appearing for the petitioner submits that petitioner is in custody from August 2025 and happens to be a taxi driver. It has been contended that there was alleged recovery from the dicky of the taxi to the extent of 26.2 Kgs. of Ganja. Charge sheet has already been submitted, as such the petitioner prays for bail on any stringent condition.
Learned advocate for the State opposes the prayer for bail and submits that the chemical examiner’s report confirmed the contraband which has been recovered.
Having regard to the quantum of contraband recovered and the period of detention as also the stage of the case, I direct that the petitioner be released on bail after the stage of
2 consideration of charges are over before the learned Special Court. Learned Special Court would impose such conditions as he would deem fit and proper for ensuring the appearance of the present petitioner in course of the trial.
With the aforesaid observations CRM (NDPS) 106 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
