[2026:RJ-JP:10695] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 3766/2026 Vinod Kumar Binwal S/o Bhagirath Prasad, Aged About 48 Years, R/o Ambedkar Colony, Village Thoi, District Sikar, Rajasthan ----Petitioner Versus Rajasthan Staff Selection Board, State Institute Of Agriculture Management Premises, Durgapura, Jaipur, Rajasthan Through Its Secretary ----Respondent For Petitioner(s) : Mr. Laxmi Kant Malpura with Ms. Shivangi Singh Patel, Mr. Jeetram Choudhary & Ms. Madhavi Vyas For Respondent(s) : HON'BLE MR. JUSTICE ANAND SHARMA Order 13/03/2026 1. The above writ petition has been filed by the petitioner challenging the denial of correction in his category in the recruitment process for the post of Class-IV employees. 2. Learned counsel for the petitioners submits that the petitioners participated in the direct recruitment process for the post of Class-IV employee initiated by Rajasthan Staff Selection Board, Jaipur. 3. In the present writ petition, petitioner belongs to SC- LD/CP category. It was submitted that Unique Disability ID number has been placed on record by the petitioner in support of his claim, yet while ignoring the same and on account of the fact that the petitioner is less educated and has no knowledge with [2026:RJ-JP:10695] (2 of 5) [CW-3766/2026] regard to computer or the process of filing the online application form, got his form filled through third person/E-Mitra, who instead of showing the category of petitioner as 'SC-LD/CP', showed the petitioner as 'SC'. 4. It is also submitted by learned counsel for the petitioner that after filing the application form, the petitioner participated in the written examination and although, he secured more marks than the cut-off marks declared for 'SC-LD/CP' candidates, yet only on account of human error occurred while submitting the application form, the petitioner was not considered in the category of 'SC-LD/CP'. 5. It is further submitted by learned counsel for the petitioner that after declaration of result, petitioner also submitted application/affidavit seeking correction in his category, yet no action was taken by the respondent-Board. It is also submitted that, in case, the petitioner was treated in the category of 'SC- LD/CP', then he would have secured proper place in the merit list for further consideration in the recruitment process. 6. I have heard learned counsel for the petitioner and perused the record. 7. Clause 17 of the advertisement issued by respondent- Board is reproduced hereunder: “17. vkWuykbZu vkosnu esa la'kks/ku dh izfØ;k%& cksMZ }kjk vkWuykbZu vkosnu esa la'kks/ku gsrq dksbZ vkWQykbZu izkFkZuk i= Lohdkj ugha fd;k tk;sxkA cksMZ }kjk tkjh foKfIr fnukad 14-07-2023 } kjk ;fn fdlh vH;FkhZ dks vius OTR esa Lo;a ds uke] firk ds uke] tUefrfFk ,oa fyax esa ifjorZu djuk gS rks mls loZizFke vius vk/kkj@tuvk/kkj esa ifjorZu djokuk gksxk rRi'pkr~ OTR LØhu ij Qsp dk cVu nckuk gksxk ftlls vk/kkj@tuvk/kkj esa ntZ uohu MkVk mlds OTR esa Lor% gh vk tk;sxkA vH;FkhZ dksa vius OTR esa vkj{k.k Js.kh] fnO;kaxtu Js.kh ,oa ewy fuokl esa okafNr la'kks/ku djus dh vuqefr nh xbZ gSA vH;FkhZ la'kks/ku djus ds mijkUr gh vkWuykbZu vkosnu HkjsaA ;fn vH;FkhZ HkrhZ dk vkWuykbZu [2026:RJ-JP:10695] (3 of 5) [CW-3766/2026] vkosnu lcfeV dj pqdk gS rks ,slh fLFkfr esa vkWuykbZu vkosnu esa la'kks/ku djus dh vof/k ds nkSjku Hkh mls Lo;a ds uke] firk ds uke] tUefrfFk ,oa fyax esa ifjorZu dh vuqefr ugha gksxhA vH;FkhZ dks ;fn vkj{k.k Js.kh@fnO;kaxtu Js.kh@ewy fuokl esa la'kks/ku djus gS rks igys mls OTR ist ij vkj{k.k Js.kh@fnO;kaxtu Js.kh@ewy fuokl esa la'kks/ku djuk gksxk blls mls Lo;a ds vkWuykbZu vkosnu esa iwoZ esa Hkjs x;s vkj{k.k Js.kh@fnO;kaxtu Js.kh@ewy fuokl esa la'kks/ku djus dk fodYi miyC/k gks tk;sxk] ftls mi;ksx esa ysdj og okafNr la'kks/ku dj ldrk gSA vkWuykbZu vkosnu Submit fd;s tkus ds i'pkr~ ;fn vkosnd dks fdlh izdkj dh =qfV dk irk yxrk gS rks vH;FkhZ vkWuykbZu vkosnu esa QksVks] gLrk{kj ,oa mu lwpukvksa dks ifjofrZr ugha dj ik,xk tks mlus OTR ds le; ntZ dh gSA 'ks"k lwpukvksa esa og la'kks/ku fuEukuqlkj dj ldrk gS%& i. ;fn dksbZ vH;FkhZ vius vkWuykbZu vkosnu esa la'kks/ku djkuk pkgrk gS rks vkosnu izkfIr dh vafre fnukad ds i'pkr~ 07 fnol ds Hkhrj fu/kkZfjr 'kqYd 300@& :i;s nsdj vkWuykbZu vkosnu esa la'kks/ku dj ldrk gSA vkWuykbZu vkosnu esa vH;FkhZ QksVks] gLrk{kj ,oa mu lwpukvksa dks ifjofrZr ugha dj ik,xk tks mlus OTR ds le; ntZ dh gS ;Fkk uke] firk dk uke] tUefrfFk] fyax bR;kfnA 'ks"k izfof'kf"V;ksa esa la'kks/ku fd;k tk ldsxkA 'kS{kf.kd ;ksX;rk esa vH;FkhZ vafre frfFk ds i'pkr~ 07 fnol esa gh la'kks/ku dj ldrs gSaA blds i'pkr~ 'kS{kf.kd ;ksX;rk ds dkWye esa cksMZ@ fo'ofo|ky; dk uke] jksy ua-] mRrh.kZ o"kZ bR;kfn esa dksbZ la'kks/ku ugha dj ldsxkA cksMZ }kjk tkjh dk;kZy; vkns'k fnukad 27-07-2023 ds vuqlkj vkWuykbZu vkosnu ds fy;s One Time Registration (OTR) esa 'kS{kf.kd ;ksX;rk esa dsoy ek= ,dckjh; la'kks/ku dh vuqefr nh x;h gSA loZizFke vH;FkhZ vius OTR esa 'kS{kf.kd ;ksX;rk esa okafNr la'kks/ku dj ysosaA vH;FkhZ la'kks/ku djus ds mijkUr gh vkWuykbZu vkosnu HkjsaA ;fn vH;FkhZ HkrhZ dk vkWuykbZu vkosnu lcfeV dj pqdk gS rks ,slh fLFkfr esa vH;FkhZ dks 'kS{kf.kd ;ksX;rk esa la'kks/ku djus gsrq igys] OTR ist ij Lo;a dh 'kS{kf.kd ;ksX;rk esa la'kks/ku djuk gksxk blls ml 'kS{kf.kd ;ksX;rk esa la'kks/ku djus dk fodYi Lo;a ds vkWuykbZu vkosnu esa vkWuykbZu vkosnu dks la'kksf/kr djus dh vof/k ds nkSjku miyC/k jgsxk] ftls mi;ksx esa ysdj og 'kS{kf.kd ;ksX;rk esa okafNr la'kks/ku dj ldrk gSA vkWuykbZu vkosnu esa la'kks/ku gsrq fu/kkZfjr Qhl tek djkus dh izfØ;k vkWuykbZu vkosnu djus dh izfØ;k ds leku gh gksxhA ii. ;fn fdlh vH;FkhZ ds vkWuykbZu vkosnu esa =qfV jg tkrh gS rFkk og fdlh dkj.ko'k vkosnu djus dh vafre fnukad ds i'pkr~ 7 fnol ds Hkhrj vius vkWuykbZu vkosnu esa la'kks/ku ugha dj ikrk gS rks mls vius vkWuykbZu vkosnu esa la'kks/ku djus dk ,d vksj vafre volj ijh{kk vk;kstu ds i'pkr~ vkWuykbZu =qfV la'kks/ku gsrq ,d fuf'pr le; fn;k tk;sxk ftlesa vH;FkhZ vius vkWuykbZu vkosnu dh =qfV dks vkWuykbZu la'kks/ku dj ldsxkA vkWuykbZu vkosnu esa la'kks/ku gsrq fnukad ,oa le; dh lwpuk i`Fkd ls cksMZ dh osclkbZV ds ek/;e ls nh tk;sxhA mDr fu/kkZfjr le; esa vH;FkhZ vius vkWuykbZu vkosnu esa fu/kkZfjr la'kks/ku 'kqYd 300@& :i;s vkWuykbZu vkosnu djus dh izfØ;k ds leku Hkqxrku dj la'kks/ku dj ldsxkA iii. blds i'pkr~ vkWuykbZu vkosnu esa fdlh izdkj dk la'kks/ku@ifjorZu Lohdkj ugha fd;k tk;sxk rFkk ,slh fdlh Hkh =qfV dk lEiw.kZ nkf;Ro vH;FkhZ dk gksxkA” [2026:RJ-JP:10695] (4 of 5) [CW-3766/2026] 8. Aforesaid Clause of the advertisement would make it clear that in order to obviate any possibility of discrepancies in the application as well as to grant opportunities to the candidates for making necessary correction in the application form, provisions have been made, where on two different occasions rectification in the application form was allowed. Firstly, the candidate could have made rectification within seven days from the last date of filing of application form and as per Clause 17(ii) of the advertisement, even after any candidate fails to make rectification and could not avail the first opportunity then, after completion of examination, second opportunity would be granted to the respective candidate for making necessary corrections. 9. In the instant case, before appearing in the examination, the petitioner was issued admit card, in which also category of the petitioner was shown as 'SC' and not as 'SC- LD/CP', even then, the petitioner did not raise any objection and appeared in the examination as 'SC' candidate. Even after examination, Board has issued one press note as well as published it on its official website granting opportunity of rectification in the application form even after completion of examination. However, the petitioner even then did not submit any application for seeking the necessary rectification. 10. It is only after declaration of result, when the petitioner found that he has not secured proper place in the selection list as per the category filed by him, he submitted application for rectification, which was not entertainable as per the Scheme of examination declared by respondent-Board. [2026:RJ-JP:10695] (5 of 5) [CW-3766/2026] 11. It is settled proposition of law that category of the candidate cannot be allowed to be changed at subsequent stage, as held by the Co-ordinate Bench of this Court at Principal Seat, Jodhpur in D.B. Civil Writ Petition No.15900/2021 (Mustak Khan Vs. The Rajasthan High Court Jodhpur & Ors.), the relevant portion of the aforesaid order is reproduced as hereunder:- "5. On the other hand, learned counsel for the respondents while relying on the judgment of this Court in Sunil Bhanwariya v. Registrar, Examination Cell, RHC, Jodhpur & Anr. submits that the petitioner having participated in the preliminary examination in the General category cannot raise this issue at belated stage after declaration of the result for the post of District Judge. 8. In the considered opinion of this Court, having participated in the examination and knowing that he has applied in the General category, he cannot be allowed to change his category from General to OBC (NCL) category. No prima facie case is made out by the petitioner. He did not file any proof to the effect that he made any endeavour to change his category in the application form from General to OBC (NCL)." 12. In the light of above discussion as well as the observations made by the Division Bench of this Court, this Court does not find any ground to interfere in the instant writ petition and, the same, is hereby, dismissed. 13. Pending application(s), if any, shall stand disposed of. (ANAND SHARMA),J DAKSH/14
