JUSTICE SANDEEP KUMAR ORAL ORDER 5 27-04-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 59 of 2011, registered for the offence punishable under Section 304/34 of I.P.C. 3. As per the prosecution case, the petitioner is husband of the deceased. As per the F.I.R., he is said to have killed the deceased. 4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that in the trial, the informant has been examined and he has said that the case was filed by him on suspicion. He is not an eye witness and the deceased and the petitioner had three children, who are staying Patna High Court CR. MISC. No.4904 of 2026(5) dt.27-04-2026 2/2 with the family of petitioner. The petitioner is in custody since 03.12.2025 having clean antecedent. 5. Learned APP appearing for the State opposes the prayer for bail of the petitioner. 6. Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada /concerned Court below in connection with Muffasil P.S. Case No. 59 of 2011, subject to the condition that the petitioner will cooperate in the trial. 7. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case. sanjeev/- (Sandeep Kumar, J) U T
