For Petitioner(s) : Mr.N.Ishak For Respondent(s) : Mr.C.S.K.Sathish, Standing counsel ORDER This writ petition is filed to direct the respondents to pay interest amount to the petitioner for the belatedly paid difference of Commutation of Pension amount at the rate of 6% per annum for 51 months of delayed payment in the light of the judgment passed by this Court on 23.10.2024 in W.P.No.30766 of https://www.mhc.tn.gov.in/judis WP No. 24183 of 2026 __________ Page2 of 4 2024 by considering the representation dated 08.06.2026. 2. The brief facts which has culminated in the filing of this writ petition are set out below: 2.1. It is the case of the petitioner that he was appointed as Junior Assistant in the respondent Corporation. The respondents ought to have settled all the retiral benefits completely including the Commutation of Pension amount on the date of retirement to the petitioner. However, the commutation of Pension was partially paid on and after his retirement and the difference of the Commutation amount of Rs.5,64,841/- was settled to the petitioner on 30.01.2021 belatedly after 51 months without any interest. Therefore, the respondents are legally bound to pay interest to the petitioner. Therefore, the petitioner made a representation to the respondent to pay the interest towards the difference of Commutation of Pension at the rate of 6% p.a., for the delayed period of 51 months. Since there is no response, the petitioner is before this Court. 3. Heard the learned Counsel on either side and perused the materials available on records. 4. Therefore, the petitioner is entitled to interest on the same. In view of the above, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to pay the eligible amount as payable to the petitioner along with 6% per annum for the delay period in settling the difference of commutation amount within a period of one (1) month from the date of receipt of a copy of this order.
