ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents to dispose of petitioner’s representation dated 13.10.2025.
2. The case of the petitioner is that he is the absolute owner of Punja land measuring 0.16.00 Hectares in S.No. 732/101, situated at Sonarahalli Village, Pochampalli Taluk, Krishnagiri District. In these circumstances, the petitioner submitted a representation dated 13.10.2025 requesting the respondents to survey the subject land and fix boundary stones with the assistance of the Taluk/ Firka Surveyor. However, the said representation has not been considered till date. Aggrieved by the inaction of the respondents, the petitioner has filed the present Writ Petition.
3. The learned Government Advocate appearing for the respondents submitted that the petitioner had submitted a manual representation instead of filing an online application. He further submitted that in the event the petitioner __________ Page2 of 5 https://www.mhc.tn.gov.in/judis
WP No. 25265 of 2026 files an online application, the same will be considered and appropriate orders will be passed in accordance with law.
4. Considering the facts and circumstances of the case and the
submissions made by both sides, this Court directs the petitioner to submit an online application for surveying the subject land and fixing boundary stones. Upon receipt of such application, the second respondent, who is the competent authority, is directed to consider the same with respect to the subject property in S.No. 732/101, situated at Sonarahalli Village, Pochampalli Taluk, Krishnagiri District, and pass appropriate orders for surveying the property and fixing boundary stones, within a period of six (6) weeks from the date of receipt of the petitioner's online application. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party.
