The instant writ petition is filed challenging the action of the respondents in not releasing the admitted amounts of Rs.10,60,000/- (Rupees Ten Lakhs Sixty Thousand only) incurred by the petitioner towards expenditure under the scheme "Best Available School Scheme" introduced by the Government for the academic year 2024-2025 and 2025-2026, 3. The Learned counsel for petitioner contends that the 1st respondent introduced a scheme, "Best Available School Scheme" in terms of G.O.Ms.No.101, dated 31.05.2008. It is submitted that the petitioner institution 3 which is a private unaided school has maintained high standards of excellence and provided all infrastructural facilities to its students. It had admitted the students under the BAS scheme and claimed the benefits of the scheme. 4. It is contended that the scheme was first introduced in 1995 and was subsequently, the Scheme was amended from time to time. The quantum of the reimbursement was fixed at Rs.20,000/- per annum for day-scholars and Rs.30,000/- per annum for hostellers. Thereafter, the 1st respondent issued G.O.Ms.No.22, dated 21.03.2017, prescribing the procedure for selection of institutions under the Scheme. 5. Learned counsel further submitted that, in terms of the Scheme, a Committee headed by the District Collector is constituted to inspect the institutions with reference to the standards of excellence and infrastructure. Based on the prescribed standards that the respective institutions have maintained, the institutions would be selected for sanction of the benefits under the Scheme. The petitioner institution was selected under the Scheme for the academic years 2024-2025 and 2025-2026. It is further contended that, despite the petitioner having incurred the expenditure and the amounts being admitted by the respondents, the reimbursement has not been released. Hence, the instant writ petition is filed. 6. Today, when the matter is taken up for consideration, the learned Assistant Government Pleader for Social Welfare placed before the Court a copy of the written instructions received from the 4th respondent, dated 4 30.06.2026. A perusal of the same would reflects that the bills submitted by the petitioner for an amount of Rs.9,70,000/- are under process and are pending clearance by the Finance Department. It is further stated that the bills were returned by the Drawing and Disbursing Officer (DDO) on 31.03.2026, as the budget for the relevant financial year had lapsed. It is further stated that, upon sanction of the requisite budget, the bills will be resubmitted for processing and payment. 7. Having regard to the above, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents to release the amounts due to the petitioner, within a period of four (04) months from the date of receipt of a copy of this order. 8. Accordingly, the Writ Petition is disposed of. No order as to costs.
