THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioners are before this Court seeking for the following reliefs; a. Issue a writ of mandamus quashing the Endorsement Bearing No.DA/PR/KTR/45/2017- 18 issued by the R2 dated 03.07.2017 vide Annexure-K. b. Issue a writ of mandamus directing the Respondents to issue the Khatha in favour of the petitioners pertaining to bearing No.1799/42/4, 43/2 formed in converted land Sy.No.42/2 & 43/2 situated at Uttarahalli, Bangalore South Taluk to the extent of Measuring 4800 Sq ft. c. To issue any other writ, order or direction as may be deemed fit in the facts and circumstances of the case in the interest of justice. 2. The petitioners are before this Court aggrieved by the rejection of the application filed by the petitioner for grant of Khata. The reason for rejection of the - 3 - HC-KAR NC: 2026:KHC:5071 WP No. 3171 of 2019 katha is on the grounds that the Khata has been sought for in respect of portion of the larger property which would amount to bifurcation and as such, the Single Plot Development Plan has been called upon to be furnished for the purpose of consideration of the said application. 3. I do not find any infirmity in the said endorsement which has been issued by respondents inasmuch as the larger property admittedly measures 3 Acers 30 Guntas and the petitioner has received 4000 Sq.ft. of said land as a gift. If a bifurcation is to be made in terms of plots it would be required for the bifurcation to be in accordance with the master plan and as such the petitioners would have to approach the jurisdiction Town Planning Authority seeking for such plan. 4. On securing the said Single Plot Development Plan, if the petitioners were to make an application to respondent No.2 for issuance of bifurcation of Khata, - 4 - HC-KAR NC: 2026:KHC:5071 WP No. 3171 of 2019 respondent is directed to consider the same and pass necessary orders within 30 days of such application being filed. 5.
