1. Heard learned counsel for the parties.
2. The instant bail application has been preferred by the petitioners for grant of regular bail for the offences registered under Sections 272, 274 and 275 of IPC and 47 (a), 55 of Excise Act.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and have committed no offence as alleged in the F.I.R. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioners, nor have they made any confession before the police. He further submits that the petitioners are drivers of the vehicle and are the sole earning members of their respective families. He further submits that the charge-sheet has already been submitted in this case. He lastly submits that the petitioners are in custody since 20.11.2025; as such, the petitioners may be enlarged on bail. He submits that the petitioners are ready to abide by every condition as imposed by this court.
4. Learned A.P.P. opposes the prayer for bail of the petitioners.

Having regard to the facts of the case and looking to the allegations made against the petitioners, coupled with the fact that the charge-sheet has already been submitted in this case and the petitioners are in custody since 20.11.2025; therefore, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Seraikella, in connection with Kandra P.S. Case No. 49 of 2025.

It is made clear that the petitioners shall appear on each and every date before the learned trial court and they shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against the petitioners, learned trial court shall be at liberty to cancel the bail of the petitioners.
