IN THE HIGH COURT AT CALCUTTA Circuit Bench at Jalpaiguri Constitutional Writ Jurisdiction
WPA No. 2131 of 2026
Swarnali Das v/s The Principal Secretary, Government of West Bengal & Ors
Mr. Sandip Guha Roy Mr. Ananda Paul …for the petitioner.
Mr. Arijit Ghosh Mrs. Rajni Singh Dev …for the State. Dr. Navin Barik Ms. Esha Acharya
For the respondent no. 2-4
Affidavit of service filed by the petitioner is taken on record.
Learned counsel for the petitioner submits that the petitioner joined the B.Com course in Ananda Chandra College of Commerce, Jalpaiguri and qualified in all the semester examinations except for one paper Business Mathematics included in the 3rd semester. She was granted two more chances to clear the said paper but did not succeed. She belongs to an extremely financially distressed family and the entire burden of looking after her family rests on her shoulder after demise of her father. She seeks mercy before the University authorities to
2 allow her to appear for the said examination as a last chance in order to enable her to complete her graduation and pursue her future aspirations. The petitioner submitted a representation in this regard before the concerned authority on 22nd May, 2026 which was turned down by the acting Registrar of the University on the ground that there was no provision for offering a special chance to candidates who have not succeeded in any of the subjects during the entire period of study. Learning counsel appearing for the University submits that the University Regulations permit only three chances to a student to clear each subject. The petitioner has not succeeded in all three chances granted to her. It is not in dispute that the University Regulations do not permit a special chance to the petitioner to appear for the examination after failure on three occasions. However, since the petitioner aspires to complete her graduation in order to support her family, the Vice Chancellor, University of North Bengal, being the 3rd respondent herein, is
directed to revisit the issue and consider the representation submitted by the petitioner on 22nd May, 2026 on a sympathetic ground and take necessary steps accordingly.
3 This Court is informed that the post of the Vice Chancellor is lying vacant at present. The Vice Chancellor shall deal with the issue as and when he joins the post. Nothing further remains to be dealt with in the writ petition. The writ petition is disposed of accordingly. There shall however be no order as costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
