The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 07/2025, registered at Police Station Sitapur, District- Sarguja (CG) for the offence 2 punishable under Section 103(1) of BNS, 2023. 2. The First Bail Application bearing MCRC No. 8757 of 2025 was dismissed as withdrawn by this Court vide its order dated 07.11.2025. 3. The prosecution story in brief, is that, one Vijay Kumar Chauhan (neighbour) lodged FIR stating that applicant has kicked his mother Riddhi Bai in her vital organs with the intention of killing her on the date, time and place of the incident. The case is at the initial stage of prosecution evidence, and most of the prosecution witnesses are close relatives of the applicant or residents of his village. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. On the alleged date of incident, a domestic dispute arose between the applicant and his wife. The deceased Smt. Riddhi Bai had gone out of the house at night to call the neighbours. The applicant has not killed his mother and without any basis, the police has registered the offence against the applicant. The applicant is in jail since 03.01.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 3 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, particularly the fact that the applicant kicked his mother on her vital organs as a result of which she died, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Chanwar Sai @ Luthru Bargah involved in Crime No. 07/2025 under Section 103(1) of BNS, 2023 at Police Station- Sitapur, District- Surguja, Chhattisgarh, is rejected. 8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 9.
