No 23/1A and 23/36 Kanakkampalayam Village, Udumalaipet Taluk, Tiruppur District based on petitioner’s online application dated 30.05.2026. 2. The petitioner purchased a house site property measuring 29 cents in S.F. Nos. 23/1A and 23/3, Kanakkampalayam Village, Udumalaipet Taluk, Tiruppur District, under registered Sale Deeds dated 08.10.1980 (Document Nos. 2740/1980 and 2741/1980). Following the purchase, the revenue records were mutated in her favour, and she has been in peaceful possession and enjoyment of the property. Subsequently, she sold a portion of the property in House Site Nos. 63 and 64 on 12.12.2013 and settled another portion in favour of her son by Settlement Deed dated 13.05.2015 (Doc. No. 3380/2015). Thereafter, her son sold 4.62 cents of the settled property to K.Sudesh Kumar on 16.02.2022. The petitioner continues to be in possession and enjoyment of the remaining extent of the property. __________ Page2 of 6 https://www.mhc.tn.gov.in/judis WP No. 24875 of 2026 3. The learned counsel for the petitioner further submitted that the petitioner had approached the respondents to survey the subject lands by submitting an online application dated 30.05.2026. However, the said application has not been considered till date. Aggrieved by the inaction on the part of the respondents, the present Writ Petition has been filed. 4. The learned Government Counsel appearing for the respondents submitted that out of the total extent of 29 cents of land, the petitioner has already sold 14.5 cents. However, the petitioner's online application erroneously requested a survey of the entire 29 cents, which cannot be entertained. 5. Per contra, the learned counsel for the petitioner submitted that the petitioner would restrict his prayer solely to the measurement and survey of the remaining 14.5 cents of land retained by him. 6. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the petitioner to submit a fresh application for measuring the land to an extent of 14.5 cents comprised in S.F. Nos. 23/1A and 23/3, situated at Kanakkampalayam Village, Udumalpet Taluk, Tiruppur District. Upon receipt of such application, the respondents are __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 24875 of 2026 directed to consider the same, conduct a field survey of the subject property, and fix the boundary stones, after issuing due notice to the petitioner, the adjoining landowners, and any other interested parties. The entire exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. 7. With the above directions, this Writ Petition stands disposed of.
