For Petitioner: Mr.R.Dhanasekar
For Respondents: Mr.Mohamed Riyaz, Government Advocate (Criminal side) For R1 *** O R D E R This Criminal Original Petition, seeks to quash the final report and all further proceedings in Special S.C.No.92 of 2023 pending on the file of the Special Court for POCSO Act cases, Thiruvannamalai for the alleged offences under Sections 5(1), 5(j)(ii) and 6(1) of POCSO Act read with Sections 376(3) and 376(2)(n) of Indian Penal Code on the ground of compromise. 2. The petitioner / accused along with the first informant, being the father of the victim child, are present before this Court. They plead that the case be quashed on compromise. 3. Since the case is one under the POCSO Act, in serious offences, this Court will not go by the version of the first informant or the prosecutrix alone. The Court has to take into account the overall facts and circumstances of this case. Firstly, upon considering the very complaint and the statements recorded during the investigation, it is seen that the petitioner/accused and the child were of distant relations. When the child used to be alone at home, after being a https://www.mhc.tn.gov.in/judis

When upon finding the same, when the father of the victim child confronted, the victim child was adamant that she will only marry the petitioner/ accused. Subsequently, it is seen that a marriage was also performed between the petitioner/accused and victim child and she has also attained the age of 18 years.
Unfortunately, due to snake bite, victim child died. A case of unnatural death was also registered in Crime No.4 of 2023. 4. The learned Additional Public Prosecutor would also confirm that upon investigation it is found that the victim child died out of snake bite. The child born out of the wedlock is being taken care of by the accused/ petitioner only. 5. In view of all the above, I am of the view that this is a fit case to exercise the jurisdiction of this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 and keeping in mind the welfare of the child that is now being taken care of by the petitioner/ accused, this Criminal Original Petition in Crl.O.P.No.15453 of 2026 stands allowed. The case in Special S.C.No.92 of 2023 on the file of the Special Court for Exclusive Trial of cases under the POCSO Act, Thiruvannamalai shall stand quashed.
