Learned counsel for the petitioner submits that the petitioner is in custody since 14.10.2025 in connection with Adityapur P.S. Case No.259 of 2019, registered under Sections 363/366-A and 34 of the Indian Penal Code, now pending in the court of learned Chief Judicial Magistrate at Seraikella. 3. The learned counsel for the petitioner submits that there is an allegation in the F.I.R. that the victim was kidnapped by others including the present petitioner and there is also further background mentioned in the F.I.R itself in connection with one occurrence of 2017 when the victim was allegedly taken to Jhunjhunu in Rajasthan and she got married with the son of the petitioner. 4. He has further submitted that the petitioner has been falsely implicated in this case, the age of the victim has also been assessed to be 19 years. 5. The learned counsel for the State has opposed the prayer and referred to the statement of the victim recorded under Section 164 of the Cr.P.C. He submits that the petitioner, along with others, had taken 2026:JHHC:8515 2 the victim to Child Welfare Committee in Orissa and then her statement was recorded. Thereafter, she was sent to shelter home in Orissa, from where she was ultimately recovered on the basis of an intimation given to the informant of the case. 6. The learned counsel for the petitioner has submitted that the petitioner has been in custody since 14.10.2025, and even if the statement of the victim is taken into consideration, then also, she was taken to a shelter home and her statement was also recorded before the Magistrate at Orissa, and upon medical examination, she was found to be major. He has submitted that so far as the case registered in the year 2017 is concerned, the son of the petitioner has already been enlarged on bail. 7. After hearing the learned counsel for the parties and considering the statement made under Section 164 Cr.P.C, the victim was allegedly taken to the Child Welfare Committee in Orissa, where her statement was recorded and her statement before the Magistrate was also recorded, and apparently one F.I.R. was earlier registered in 2017. There is delay of registering the present FIR by one year. The petitioner is in custody since 14.10.2025, the charge sheet has been submitted and charges have already been framed. 8. Considering the aforesaid facts and circumstances, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/-(Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate at Seraikella in connection with Adityapur P.S. Case No.259 of 2019, on the following conditions: 2026:JHHC:8515 3 (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. 9. The instant application is allowed with the aforesaid conditions. 10.
