The brief facts which has culminated in the filing of these writ petitions are set out below: 2.1. It is the case of the petitioners that they are the retired employees of the respective respondent Corporation. The respondents settled the terminal benefits of the petitioners with a delay after several months. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 18% p.a., for the belated payment of the petitioner’s terminal benefits. Since there is no response, the petitioners are before this Court. 3. Heard the learned Counsel on either side and perused the materials available on records. 4. Admittedly, the terminal benefits of the petitioners has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. (i)Therefore, the Writ petition in W.P.No.24238 of 2026 is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Encashment of Earned Leave to the 1st petitioner and to disburse the 6% interest for belated payment of Provident https://www.mhc.tn.gov.in/judis WP No. 24238 of 2026 __________ Page5 of 8 Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender Leave, and Commuted Value of Pension to the other petitioners within a period of one (1) month from the date of receipt of a copy of this order. (ii)Therefore, the Writ petition in W.P.No.24243 of 2026 is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund , Death Cum Retirement Gratuity, Encashment of Earned Leave, Surrender Leave, and Commuted Value of Pension to the petitioners within a period of one (1) month from the date of receipt of a copy of this order.
