1.10.2026 1 sb Ct. no. 5 Calcutta High Court In the Circuit Bench at Jalpaiguri CRR 122 of 2026 Anant Kabra Vs. Ria Kabra Dr. Arjun Chowdhury Ms. Sunayana Parveen Mr. Riya Agarwala …for the Petitioner Mr. Hillol Saha Poddar …for the Opposite party Affidavit of service filed by the petitioner is taken on record. In this application, the petitioner has prayed for a direction upon the court below for expeditious disposal of Criminal Appeal no. 17 of 2025 arising out of Misc. Case no. 96 of 2023 under Section 29 of the Protection of Women from Domestic Violence Act, 2005, presently pending before learned Additional District & Sessions Judge, 1st Court, Siliguri. Being aggrieved by the delay caused in disposal of the appeal, learned counsel for the petitioner submits that an ex parte order granting monetary relief was passed against the petitioner/husband wherein the petitioner has been directed to pay Rs. 99,000/- per month along with Rs. 99,00,000/- towards compensation and other consequential relief. 2 Being aggrieved by the aforesaid order, the petitioner as appellant preferred aforesaid Criminal Appeal being no. 17 of 2025 on 30th June, 2025. Since then, the appeal is pending for hearing though the respondent appeared in the appeal. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and considering the submissions made on behalf of the petitioner and the opposite party herein, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 122 of 2026 is hereby disposed of with a direction upon the court below to dispose of the Criminal appeal being no. 17 of 2025 preferably within a period of 60 days from the next date of hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
