Heard Ms. Sakshi Chhabra, learned counsel for the petitioners. Also heard Mr. Shailendra Sharma, learned Panel Lawyer, appearing for the State/respondent No.1 and Mr. Kaif Ali Rizvi, learned counsel, appearing for respondent No.2. 2. The present petition under Section 528 of BNSS has been preferred by the petitioners with the following prayer : “It is therefore prayed that, this Hon'ble Court may kindly be pleased to allow this instant petition and quash the FIR bearing Crime No.89/2023 dated 12/08/2023 as well as the Charge Sheet bearing No.02/2025 dated 20/01/2025 filed against the petitioners by the Police Station Mahila Thana, Durg (C.G.) for commission of offence punishable under section 498A and 34 of the Indian Penal Code and entire proceedings of the RCC No.422/2025 pending before Judicial Magistrate, First Class, Durg, District Durg (C.G.), in the interest of justice.” 3. Learned counsel for the petitioners submitted that the dispute between the parties being matrimonial in nature has been amicably settled between the parties and an affidavit to that effect has been filed by respondent No.2 / complainant. It is further 3 submitted that the divorce has also been taken place between the petitioner No.1 and respondent No.2 from the Court of learned Family Court at Patiyala on 02.08.2025, hence, she prayed for quashing of the impugned FIR as well as proceedings of the RCC No.422/2025 pending before Judicial Magistrate, First Class, Durg, District Durg (C.G.). 4. Considering the fact that an affidavit sworn by the complainant / respondent No.2 has been filed along with the instant petition seeking quashment of the impugned FIR as well proceedings as well as proceedings of the RCC No.422/2025 pending before Judicial Magistrate, First Class, Durg, District Durg (C.G.), we direct that the petitioner No.1 and respondent No.2 / complainant along with other petitioners shall appear before the concerned trial Court and submit an appropriate application and the trial Court, after verifying the compromise entered between the parties, shall pass appropriate orders preferably within a period of three weeks. 5.
