HC-KAR NC: 2026:KHC:3047 WP No. 321 of 2026
2. Learned Additional Government Advocate raises a preliminary objection that the petitioner is raising a challenge to an
order passed by the Assistant Commissioner under Section 136(2) of the Karnataka Land Revenue Act, which is an appealable order before the Deputy Commissioner. Learned counsel for the petitioner however, submits that the petitioner is not a party to the proceedings before the Assistant Commissioner and therefore, this writ petition has been filed.
3. Even if it is a fact that the petitioner is not a party to the proceedings before the Assistant Commissioner, now that the petitioner is seeking to raise a challenge to the
order passed by the Assistant Commissioner, it is always open for the petitioner to file a revision petition before the Deputy Commissioner urging the same grounds. That being the position, the writ petition stands disposed of, reserving liberty to the petitioner to approach the Deputy Commissioner.
